TERMS AND CONDITIONS
Effective Date: 09/18/2026; Last Updated:
1. Acceptance of Terms
By accessing or using the Fresh Out website, submitting a form, calling or texting Fresh Out, downloading the Fresh Start Inventory, or enrolling in the Fresh Out Launch Path (together, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Services.
2. Description of Services
Fresh Out provides consulting, guidance, coaching, and practical support to help individuals navigating a major life transition identify their existing skills and resources and build a realistic plan toward income, independence, or a new career (the "Fresh Out Method": Find → Build → Connect → Launch), including through the Fresh Out Launch Path program and related resources.
Fresh Out is not a law firm, medical provider, financial institution, or licensed clinical/mental health service. Nothing provided through the Services constitutes legal, medical, financial, investment, tax, or clinical advice, and no attorney-client, doctor-patient, or similarly privileged relationship is created by using the Services. You should consult a qualified professional for advice specific to your legal, medical, or financial situation.
No outcomes are guaranteed. Fresh Out does not promise or guarantee any specific result, including but not limited to income, employment, business success, sales, bookings, or any other outcome. Results depend on many factors outside Fresh Out's control, including your own effort and circumstances. Any examples of past results referenced by Fresh Out (in marketing materials or otherwise) are illustrative only and not a guarantee of similar results for you.
3. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this requirement.
4. Automated Communications and Consent to Contact
By providing your phone number or email address, you consent to be contacted by Fresh Out by phone (including by our AI Voice Agent), text message, and email regarding your inquiry or the Services, subject to the SMS opt-out and other terms described in our Privacy Policy. Calls may be answered or placed by an AI-based voice assistant; if you're ever unsure whether you're speaking with a person or an AI system, you may ask, and we will tell you clearly.
5. User Conduct
When using the Services, you agree NOT to:
- Provide false or misleading information
- Use the Services for any unlawful purpose
- Harass, threaten, or abuse Fresh Out staff, contractors, or the AI Voice Agent
- Attempt to interfere with, disrupt, or gain unauthorized access to Fresh Out's systems or the CRM platform
- Use any content or materials provided by Fresh Out for a purpose other than your own personal use, except as expressly permitted
6. Program Participation (Fresh Out Launch Path)
If you enroll in the Fresh Out Launch Path or any other paid program, additional program-specific terms (such as session schedule, format, and expectations for participation) will be provided at enrollment and are incorporated into these Terms by reference. Active, good-faith participation is expected to get value from the program; Fresh Out is not responsible for outcomes if you do not participate as agreed.
7. Payment Terms
Fresh Out will confirm pricing for its program and services with you directly before you're asked to pay. General pricing information referenced on our website is presented as a range and is not a binding quote until confirmed.
Deposits: A deposit (to be determined before the start of the program) or your first scheduled payment under an agreed payment plan is required to reserve your spot in the Fresh Out Launch Path. The deposit is applied toward your total program cost, not charged in addition to it. Single sessions (such as a Strategy Session) are paid in full at the time of booking rather than by deposit.
Cancellation: Appointments (including Strategy Sessions and discovery calls) may be rescheduled at no charge with at least 24 hours' notice. Cancellations or no-shows with less than 24 hours' notice may require a $25 rebooking fee before a new time is scheduled. Once enrolled in the Fresh Out Launch Path, your start date may be rescheduled once at no charge if you notify us at least 7 days before your scheduled start.
Refunds: If you cancel within 3 business days of enrolling in the Fresh Out Launch Path, and before your Week 1 session has taken place, you will receive a full refund of any amount paid. After Week 1 has begun, payments are non-refundable, reflecting the time and work already invested on your behalf, though Fresh Out may offer a prorated credit toward future services at its discretion in cases of genuine hardship.
Late or failed payments:If a scheduled payment fails, we'll notify you and attempt to process it again. You'll have 5 business days to resolve a failed payment before your spot or ongoing access is paused. We don't charge late fees — our goal is to get you back on track, not penalize you for a payment hiccup. If payment issues continue without communication, Fresh Out reserves the right to pause or end services until the account is brought current.
8. Intellectual Property
All content provided by Fresh Out, including the Fresh Start Inventory worksheet, website content, program materials, and any other resources, is owned by Fresh Out or its licensors and is provided for your personal, non-commercial use only. You may not copy, reproduce, distribute, resell, or create derivative works from Fresh Out's materials without prior written permission.
If Fresh Out shares your story, feedback, or testimonial publicly (for example, on the website or in marketing materials), we will only do so with your prior consent, and you may withdraw that consent for future use at any time by contacting us, though we may not be able to remove materials already distributed.
9. Third-Party Services and Links
The Services may reference or link to third-party websites, tools, or platforms that are not owned or controlled by Fresh Out. We are not responsible for the content, privacy practices, or terms of any third-party service.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FRESH OUT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR OUTCOME WILL RESULT FROM USING THEM, INCLUDING WHERE AI-BASED TOOLS (SUCH AS THE AI VOICE AGENT) ARE INVOLVED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESH OUT AND ITS OWNERS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF INCOME, PROFITS, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICES. FRESH OUT'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO FRESH OUT IN THE SIX MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Fresh Out and its owners, contractors, and service providers from any claims, damages, or expenses (including reasonable attorney's fees) arising from your violation of these Terms or your misuse of the Services.
13. Dispute Resolution
Before pursuing formal action, both parties agree to attempt to resolve any dispute informally by contacting the other directly. If unresolved after 30 days, disputes will be resolved through binding arbitration on an individual basis (not as part of a class action), administered by JAMS, in Cook County, IL, except that either party may bring an individual claim in small claims court if it qualifies.
14. Termination
Fresh Out may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to Fresh Out, its staff, or other individuals. You may stop using the Services at any time.
15. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles.
16. Changes to These Terms
Fresh Out may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms. We will update the "Last Updated" date above when changes are made.
17. Entire Agreement; Severability
These Terms, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and Fresh Out regarding the Services. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

A local product-based business needed a better way to sell online. With help building out its online presence across social commerce and ecommerce tools, it generated about $3,000 in online sales in two weeks.

A skilled mechanic had access to salvage-yard parts and real hands-on knowledge. Instead of treating that as just a favor for friends, the opportunity was shaped into a side income path: finding, reselling, and installing parts people already needed.

A retired comedian had the experience and personality, but needed a modern content presence. Fresh Out helped get the foundation started across short-form and video platforms so the next step could become visibility, audience growth, and future bookings.
